Ahead of Retrial, Cosby's Attorneys Ask to Have Case Tossed

Attorneys for comedian Bill Cosby filed two motions on Thursday to dismiss the sexual assault case levied against him ahead of an April retrial.

Cosby spokesman Andrew Wyatt said defense attorneys filed one motion alleging prosecutorial misconduct and another claiming the statute of limitations has passed.

In the motion alleging prosecutorial misconduct, Cosby's defense team says prosecutors failed to disclose that they interviewed a friend of Constand. That friend told detectives that Constand said she had not been sexually assaulted, Cosby's attorneys said in court documents.

The defense says the interview was never disclosed to them and the notes from that day were destroyed.

A spokeswoman for the Montgomery County District Attorney's Office confirmed the filings, but did not have comment.

The 80-year-old "Cosby Show" star is accused of drugging and sexually assaulting Andrea Constand, a former Temple University basketball staffer, at his Cheltenham home in 2004.

Cosby has maintained the encounter was consensual.

A trial last June ended in a hung jury. The retrial is set to begin on April 2.

Ticket Service Fees Take Unionville Mom By Surprise

Brie Angle’s headache began because wanted to get a jump on buying her kids concert tickets to see Kidz Bop at the Oakdale Theater in June.

She went to Google and searched for Oakdale Theatre.

"I clicked on the first link that popped up which said Oakdale Theatre tickets. And I kind of quickly went through. They had a bunch of concerts and show listed for the spring," she said.

Angle thought she was buying the tickets directly from the Oakdale, so she picked her seats and checked out. She said she acknowledged the website’s no refunds and exchange policy without paying much attention to the total.

A few hours later, Angle noticed an $800 dollar charge in her email along with the seven tickets.

She noticed the value printed on the tickets was $55, while she had paid $87 each. That’s when she realized she hadn’t purchased the tickets directly through the Oakdale, but rather through a third-party seller, Online City Tickets.

Angle was charged a service fee of $24.54 per ticket, plus $6.95 to have the tickets emailed to her.

At first, she thought the company made a mistake, so she reached out to customer service.

"They told me that they are an online resell wholesaler and that the tickets are non-refundable and non-exchangeable. And that there was nothing that they can do," she said.

Angle admitted to rushing through the checkout process. Frustrated, she asked NBC Connecticut Responds if there was anything we could do.

After a member of our Consumer Investigative Center reached out to Online City Tickets, Angle received a call from the company.

An agent told her the company would refund the service and delivery fees, a total of $192.73.

NBC Connecticut Responds also compared service fees among several sites.

Ticketmaster had the lowest, at $15.50 per ticket and free email delivery. StubHub’s service fee is $20.98 per ticket, with free email delivery. Vivid Seats charges a fee of $21.45 per ticket, along with a $6.95 delivery fee.

Next time, Angle says she’ll be more vigilant about what she’s buying.

Person Who Sent False Missile Alert Not Cooperating in Probe

The person who transmitted a false missile alarm that terrorized the state of Hawaii this month is not currently cooperating with the Federal Communication Commission investigation, an FCC official said Thursday.

"We hope that person will reconsider," Lisa Fowlkes, chief of the FCC's Public Safety & Homeland Security Bureau, told the Senate Commerce, Science and Transportation Committee in Washington, D.C.

The Jan. 13 alert of a ballistic missile alert sent people seeking shelter, some in basements or crammed inside bathtubs. The false alert came amid heightened tensions between the U.S. and North Korea, which has conducted nuclear tests and intercontinental ballistic missile tests and has claimed a missile can reach the continental United States.

Fowlkes called the false alert "absolutely unacceptable" and said that the Hawaii Emergency Management Agency is working with its vendor to put in place technical safeguards, and has since required that two people sign off on any tests or alerts.

Catholic School in West Haven to Close At End of the Year

Our Lady of Victory School in West Haven will close at the end of the school year, according to the Archdiocese of Hartford.

Officials cited financial struggles as the reason for the decision to close the school, located at 620 Jones Hill Road.

“It is with a heavy heart that I made this difficult decision. Our Lady of Victory (OLV) School is blessed with dedicated students, teachers and administrators, but sadly the school’s financial reserves have been depleted over the years due to declining enrollment, escalating costs of operation, and diminishment of parish subsidies. The bottom line is that the school can no longer sustain itself,” wrote Fr. Kevin Dillon, pastor of Our Lady of Victory (OLV) School and parish in a statement.

The school community was notified Thursday. There are 94 students from pre-K through eighth grade at the school, which officials said is not enough to keep the school going.

Families that have deposits down to attend OLV will be refunded that money.

Families are encouraged to look into other Catholic schools for future education. There are other Catholic schools in the area, including St. Lawrence, School at 231 Main Street in West Haven, two miles from OLV. There are also options in New Haven and other surrounding towns.

Trump Ordered Mueller Fired, But Backed Off: Report

President Donald Trump ordered the firing of Special Counsel Robert Mueller last June, the New York Times reported Thursday.

Citing "four people told of the matter," the newspaper said Trump ultimately backed off following a threat from the White House counsel to resign.

Mueller learned about the president's withdrawn directive in recent months, according to the Times.

Hartford Police Investigate Fatal Crash

Hartford police are investigating a fatal crash on Barbour Street Thursday night.

Hartford Police Deputy Chief Brian Foley confirmed the crash happened in the area of Barbour and Westland Streets. Injuries and at least one fatality have been reported.

Foley said there was one suspect in custody. No other details were immediately available.  

NBC Connecticut has a crew headed to the scene and will provide updates as they come into the newsroom.

Man Dead After Fire in Killingworth

A man is dead after a fire on Bridle Path Trail in Killingworth Thursday night.

Firefighters responded to the home at 9:46 p.m. and found the man dead after putting out the fire.

Police believe he was the only resident of the home. 

The office of the Chief Medical Examiner will perform an autopsy. The man’s name has not been released, pending notification of his family. 

The state fire marshal is investigating.

USA Gymnastics Board Has 6 Days to Resign Or Else

Following the Larry Nassar scandal, the United States Olympic Committee has demanded that USA Gymnastics meet six conditions — including the resignation of its entire board by the end of next week — or else face decertification.

USOC CEO Scott Blackmun sent a letter Thursday to the USAG board outlining the demands for the institution. 

In the letter he wrote, “While the USOC encourages USAG to think and act broadly on reforming its culture, we also believe that reform must start with an entirely new board." 

Additional measures include requiring all staff and board members to complete comprehensive ethics training within six months.

The USAG board has six days to resign, or else its status as the sport’s governing body will be terminated, the USOC said.

US Economic Growth Slows, But Consumer Spending Surges

Economic growth in the United States unexpectedly slowed in the fourth quarter as strong consumer spending resulted in a surge of imports, Reuters reported. Gross domestic product increased at a 2.6 percent annual rate after economists had forecast 3 percent for the final three months of 2017. The new numbers contrast with a 3.2 percent growth rate for the third quarter. Still, consumer spending, which accounts for more than two-thirds of U.S. economic activity, increased at a 3.8 percent rate in the fourth quarter — the quickest pace in three years. Imports grew at a 13.9 percent rate.

Man Dead in Naugatuck Mobile Home Fire

A man is dead after fire broke out in a Naugatuck mobile home early Friday morning.

Firefighters were called to Idleview Park at on Idleview Drive around 1:30 a.m. for a fully engulfed structure fire. 

Two women were able to escape the fire and told fire officials a man was still sleeping in a back bedroom of the home.

Firefighters tried to get inside, but heavy smoke and fire kept them from getting to the man in time. By the time firefighters got to him, he had died, officials said.

The man's name has not been released.

Surrounding mobile homes were evacuated and mutual aid was called in from Middlebury, Oxford and Beacon Falls to help fight the fire.

There are no hydrants in the area, so firefighters had to bring water in by truck.

Officials said damage to the mobile home is extensive. The Red Cross is assisting residents of the mobile home.

There is a full propane tank on the property and officials were worried that it might explode. 

The cause of the fire is under investigation.

ICE Gains Access to National License Plate Database: Report

Immigration and Customs Enforcement has finalized a contract that gives the agency access to location-tracking info for license plates across the country, The Verge reported.

The move has fueled concerns by civil liberties groups, especially as the Trump administration homed in on so-called sanctuary cities.

The contract comes after years of internal ICE lobbying and includes some limits on surveillance like audit logs to trace abuse of the system. While the source of the data is not named in the contract, an ICE representative said the data came from Vigilant Solutions, based in Livermore, California.

"Like most other law enforcement agencies, ICE uses information obtained from license plate readers as one tool in support of its investigations," spokesperson Dani Bennett said in a statement to The Verge. "ICE is not seeking to build a license plate reader database, and will not collect nor contribute any data to a national public or private database through this contract."

Man Charged With Attempted Murder and Arson After Fire in Norwich

Norwich police have arrested a man and charged him with attempted murder and arson after an investigation into a fire that started early Wednesday morning.

Norwich firefighters responded to 261-263 Central Ave., a building with two businesses and two apartments, at 12:24 a.m. Wednesday and found fire from the rear deck, stairs and siding.

Several people were in the building at the time and were able to get out after fire alarms went off, police said. A Norwich firefighter sustained a minor injury while fighting the fire.

Investigators determined that the fire was set and Norwich police detectives and the fire investigation unit arrested 38-year-old Tyree Davis, of Taftville. He has been charged with criminal attempt at murder, arson in the first degree, reckless endangerment in the first degree and criminal mischief in the first degree.

Detectives served the warrant on Davis, who is a registered sexual offender, while he was appearing at Norwich Superior Court for a separate arrest in Norwich, police said.

Davis was arrested on a warrant issued in December 2017 charging him with violation of a standing criminal protective order and was held on a $100,000 bond for that case.

He has been held in lieu of an additional $1 million bond.

Police said Davis refused to fully cooperate with the booking process and was also charged with failure to submit to fingerprinting. He was held an additional $5,000 bond.

Police said the warrant is sealed.

Over 60,000 Facebook Users Agreed to Fake Events by Russians

Facebook admitted in a letter to the Senate Intelligence Committee this month how it may have unintentionally recommended Russian propaganda on its social network to some users, CNBC reported. 

Facebook said in the letter that Russian groups used the platform to promote events. A total of 129 were created and over 60,000 Facebook users said they intended to attend those events, CNBC reported.

Facebook sent a follow up letter to the Senate Intelligence Committee after the social media giant received additional questions following its hearing in November. The letter was made public on Thursday, CNBC reported. 

Since last year, the tech giant has been under scrutiny by government officials and the public for its failure to initially recognize how Russians were using it to push propaganda.

8 Times Larry Nassar Could Have Been Stopped

At Larry Nassar's sentence hearing, the 156 women who gave testimony chiding the former Team USA gymnastics doctor were just as angry at the institutions he worked at for ignoring decades of opportunities to stop the abuse.

Larissa Boyce, was a 16-year-old gymnast at a Michigan State University youth program in 1997 when she and another girl told coach Kathie Klages they were uncomfortable with how Nassar put his hands inside them, NBC News reported. Klages "interrogated" the girls and told them they misunderstood what Nassar had done.

In 1999, MSU staff referred runner Christie Achenbach to Nassar for an injured hamstring. She was shocked when he rubbed her pelvic area and penetrated her with his fingers. She told her coach who, she said, told her he was a respected doctor and she should trust him.

Through 2015, there were at least six other times when women say they reported Nassar's behavior but were ignored, allowing him to continue abusing them while racking up a list of new victims.

West Hartford Police Search For Purse Theft Suspects

West Hartford police are trying to find two women who they say tried to use a stolen credit card at Westfarms.

The women stole a purse from a customer at Trader Joe's on New Britain Ave on January 17, police said.

They went across the street to Westfarms where investigators said they tried to use the victim’s credit card to buy items.

Rep. Joe Kennedy to Deliver Dems State of the Union Response

Rep. Joe Kennedy III of Massachusetts will deliver the Democratic response to President Donald Trump's State of the Union address next week.

House Democratic Leader Nancy Pelosi and Senate Democratic Leader Chuck Schumer made the announcement in a statement Thursday night. They called Kennedy "a relentless fighter for working Americans."

"Congressman Kennedy profoundly understands the challenges facing hard-working men and women across the country,” Pelosi said.

The 37-year-old grandson of the late Robert F. Kennedy is serving his third term in the House. Kennedy rose to national prominence with a series of viral speeches chiding the president on health care and his lackluster response to the fatal white supremacist rally in Charlottesville, Virginia.

"From health care to economic justice, to civil rights, the Democratic agenda stands in powerful contrast to President Trump's broken promises to American families," said Kennedy. "I'm honored to have been chosen by Leader Pelosi and Leader Schumer to deliver our party's response."

"So proud of Congressman Joe Kennedy III! His honesty, humility and empathy are just what Americans need to hear after a year of Donald Trump's unparalleled scandals," posted aunt Kerry Kennedy on Facebook. "He's going to do a great job."

Kennedy lives in Newton with his wife, Lauren Birchfield Kennedy, and their two children, Eleanor and James. 

This is the first official State of the Union that Trump will deliver as president. A month after taking office, Trump gave an address to a joint session of Congress with all the Pomp and Circumstance of a State of the Union address — which traditionally happens after the president's first year in office. 

The last State of the Union was delivered by former President Barack Obama on Jan. 12, 2016. Then South Carolina Gov. Nikki Haley gave the Republican response.

The State of the Union will air on Tuesday, Jan. 30 at 9 p.m. ET

Pastor Who Confronted Police After Arrest in East Haven Church Resigns

An East Haven pastor who confronted police officers after they went into her church to arrest a suspect in a violent case of domestic violence has resigned.

The pastor, Rev. Care Goodstal Spinks, confronted police officers outside Old Stone Church after they arrested 34-year-old Ryan Champlin.

Police said Champlin went to the church Tuesday after assaulting his 59-year-old mother following an argument about him not paying to live at their residence. When Champlin’s mother tried to call 911, her son pushed her to the ground, police said.

Champlin's mother locked herself in her bedroom, but her son kicked the door open, grabbed the cordless phone from her and hit her in head with it several times, breaking the phone, then fled from the home, police said.

Officers received a tip that Champlin had been dropped off at the Old Stone Church at 251 Main St. in East Haven, so officers contacted church employees who said they weren’t sure if Champlin was inside but invited them in to look for him, police said.

After officers apprehended Champlin, the church pastor arrived at the scene and confronted officers after the arrest, saying the church is a sanctuary and officer had no authority to go in.

Church officials responded to the incident through a Facebook post on Thursday night and said the “behavior and language on video by the Intentional Interim Pastor, do not necessarily express the opinions of the wider congregation. We have accepted a letter of resignation from the interim pastor -effective immediately.”

Police said the Old Stone Church runs a daycare, the Old Stone Playschool, out of the same building as the church and they do not believe Champlin was in contact with any children.

Church officials said the arrest of Champlin happened during naptime and in the office, which is located on the other side of the building, and the children did not see what happened.

"The children were safe and never knew what happened. Thanks to our devoted teachers who remained calm in the midst of a very difficult situation. Rev. Care is no longer employed by the Old Stone Church," church officials said in a Facebook post.

NBC Connecticut reached out to the pastor earlier in the week, but she was not available.

Suspect in Shooting at Krauszer’s in East Hartford Considered 'Armed and Dangerous'

Police are looking for the person who shot a man in the leg at the Krauszer’s at 468 Main St.in East Hartford early on the morning of Thursday, Jan. 18 and they said the suspect they have identified is considered armed and dangerous. 

Police said they have obtained warrants for 26-year-old Carlton Depeyster, of New Britain.

Authorities said they were involved in the shooting at 1:13 a.m. on Jan. 18. 

The victim man was shot during a fight and has been released from the hospital.

Police have identified Depeyster as the suspected shooter and have obtained a warrant charging him with first-degree assault, criminal use of a firearm and criminal possession of a firearm. 

He should be considered armed and dangerous, according to police.

Police Investigate Attempted Robbery at TD Bank in New Haven

New Haven police are investigating an attempted robbery at a TD Bank on Foxon Boulevard Friday.

Officers were called to the location at 466 Foxon Boulevard at 10:49 a.m.

No one was harmed during the attempted robbery.

New Haven police described the suspect as a stocky man. He was dressed in a lime-green reflective vest over a white or cream-colored jacket, blue jeans with paint stains, a yellow hard-hat, and work boots.

The suspect had a goatee and wore glasses.

No weapon was shown, but the robber gestured as if he had one on hand, according to police.

The suspect fled without any money and was last seen walking near Walmart.

Domino's Deliveryman Robbed of Car in New Haven

A 50-year-old Domino's deliveryman was robbed of his car while making a delivery in New Haven Thursday night.

New Haven Police said the deliveryman entered an apartment complex at 40 Donna Drive around 9 p.m. looking for the customer who placed the food order.

Another man grabbed the deliveryman's car keys, and drove off with his white 2007 Hyundai Accent, Connecticut license plate AL9033, according to police. He was last seen heading north onto Middletown Avenue.

The victim was not hurt.

The suspect is a man about 5'06" tall, thin, and clean shaven. He was wearing a blue jacket, denim jeans, and a baseball cap.
