I-91 North in Hartford Reopens After Vehicle Fire

Interstate 91 north in Hartford has fully reopened after a vehicle fire closed multiple lanes on Sunday.

The vehicle fire closed the two right lanes between exits 33 and 34, according to the Connecticut Department of Transportation.

The lane closures caused some traffic delays in the area.

The highway has since fully reopened.

It is unclear if anyone was injured in the vehicle fire.

Missing Wentworth University Student Found Dead

A missing Wentworth Institute of Technology student who was last seen early Saturday morning in Boston was found dead at the base of a nearby cliff in the city's Roxbury neighborhood, according to authorities.

The body of 19-year-old Maximillian Carbone was found by searchers at the bottom of a cliff behind a red building on Terrace Street in the Roxbury on Sunday morning, about a block from where he was last seen early Saturday morning after leaving a house party in the Allegheny Street area in the Mission Hill neighborhood.

According to Bill Powers, director of public safety at Wentworth Institute of Technology, Carbone reportedly told friends he was going to stop at a nearby store. 

"His phone was pinging in the Mission Hill area," Powers told NBC10 Boston. 

More than 100 people assembled at Wentworth Institute of Technology around 7a.m. on Sunday to search for Carbone.

The search was called off on Sunday shortly after 8 a.m., and crime scene tape was set up on the corner of New Cedar and Terrace streets in Roxbury. 

Originally from Nahant, Carbone was a sophomore at Wentworth Institute of Technology studying biomedical engineering. Carbone's parents described him as a "sweet, happy and loving son, brother and friend." 

"He was a hardworking student who cared about helping people," Carbone's parents said in a public statement. 

Eric Overstrom, Wentworth’s senior vice president for academic affairs and provost said the institution is "devastated by the loss of Max Carbone."

"He had many friends within and outside Wentworth, and a warm and loving extended family who will all miss him dearly," Overstrom said.  

"Wentworth will continue to work with the Boston Police Department to understand how this tragedy could have happened and what, if anything, could be done in the future to prevent a similar situation," Overstrom said.  

According to Boston police, Carbone's death does not appear to be suspicious.

The investigation is ongoing.

Suspected Rhino Poacher Killed by Elephant Then Eaten by Lions

A suspected poacher was attacked and killed by an elephant before being eaten by a pride of lions in a national park in northeastern South Africa last week, NBC News reported.

Officials with the Kruger National Park said the family of the man, who is believed to have gone into the park to poach a rhino, got a call from his partners saying he was killed by an elephant on Tuesday.

A search party was launched, but the body could not be located in the area that the family described.

Park rangers recovered what was left of the poacher’s remains on Thursday.

"Indications found at the scene suggested that a pride of lions had devoured the remains leaving only a human skull and a pair of pants," a statement from the park said

Four of the man’s alleged accomplices have been arrested and are expected to appear in court.

Whitney Avenue in Hamden Reopens Following Crash

Whitney Avenue in Hamden has reopened after a crash with injuries closed it for part of the afternoon on Sunday.

Firefighters were called to a crash at the intersection of Whitney Avenue and Bittersweet Lane around 1:30 p.m.

According to Hamden fire officials, one patient was transported to Yale-New Haven Hospital. Firefighters did not release details about the severity of the patient's injuries.

Whitney Avenue near Lovig Lane was closed temporarily, but has since reopened.

Suspect Arrested in Nipsey Hussle Killing

Police arrested a man they say shot and killed rapper Nipsey Hussle in Los Angeles. Eric Holder was taken into custody on Tuesday. Police said Holder and Hussle were in some type of argument before Holder left the area and returned with a gun. See more on the arrest here.

Bizarre Twist

A person claiming to be a 14-year-old boy who went missing from Aurora, Illinois, at the age of 6 was actually a 23-year-old man from Ohio, police said Thursday. According to police, a DNA test proved the man was not Timmothy Pitzen, who has not been seen in more than seven years. For more on the man claiming to be Timmothy, click here.

Movie Time

The Mansfield Drive-In opened for the season this weekend. The theater has been showing movies for more than 60 years and has been owned by the same family for the past 45 years. The drive-in will be open on weekends until mid-June, when it will be open every night for the remainder of the summer. See more on the drive-in here.

Troopers ID Man Killed in Crash on Route 140 in Ellington

Connecticut State Police have identified the man who was killed in a crash on Route 140 in Ellington early Sunday morning.

Troopers said 26-year-old Sean Ruel, of Ellington, was traveling westbound on Crystal Lake Road near the intersection of Webster Road shortly before 1 a.m.

While he was driving, police said he failed to negotiate a curve, hit an embankment off the right shoulder of the road and flipped his vehicle.

Ruel was pronounced dead at the scene, according to state troopers.

Route 140 was closed while police conducted an investigation, but it has since reopened.

Anyone with information about the crash is asked to contact Trooper Burzdak at Troop C in Tolland at (860) 896-3200.

The cause of the crash remains under investigation.

Man Last Seen Wearing Hospital Gown Reported Missing From Hartford

A man who was last seen wearing a hospital gown has been reported missing from Hartford on Sunday.

According to police, 56-year-old Attardo Biagino was last seen wearing a green hospital gown and blue scrub pants. He has been missing since Sunday.

Biagino has brown hair and brown eyes. He is 6'0" tall and weighs 169 pounds.

Locally moderate to heavy rain will arrive after 4am Monday morning and last through the morning commute. Rain looks to taper off around, or just before, lunchtime. Locally heavy downpours and perhaps a rumble of thunder are possible in the evening as a cold front pushes through, though many areas look to stay dry.

It's not just the rain we're tracking, but a tricky temperature forecast as well. Right now temperatures look to stay in the upper 50s and low 60s for Monday, but getting cooler in the mid to low 50s for Tuesday.

Rain chances increase again as we look towards the end of the week and start of the weekend.

Hartford Road Partially Closed After Car Was Stuck in Hole

A street in Hartford is partially shut down after a big hole appeared in the road Sunday afternoon, police said.

A car was driving down Marshall Street when part of the street collapsed underneath the vehicle. The car had to be towed out of the hole, according to police.

Police said that after the car was towed, the driver was able to leave the scene with no damage.

The Metropolitan District Commission of Connecticut is at the scene to repair the hole.

Officials are unsure of what caused the road to cave. Police are referring to the hole as a hazard.

It is unknown how long it will take to fix the hole.

Racial Slurs Spray Painted on Two CCSU Buildings

Police are investigating after racial slurs were spray painted on the side of the Central Connecticut State University Student Center and nearby Welte Garage on Sunday.

A spokesperson for the university said a Facilities Management team responded shortly after campus police were notified of the incident and began removing the spraypaint.

A second chemical treatment is necessary to completely remove the paint from the exterior of the Student Center.

The final application of the chemical treatment will be made on Monday.

For now, a banner has been hung to completely cover the spraypaint, the spokesperson said.

George H.W. Bush Honored With 'Forever' Stamp

Former President George H.W. Bush will be honored with a commemorative "forever stamp," the U.S. Postal Service announced Saturday.

The USPS will issue the stamp June 12 -- Bush's birthday -- at the George H.W. Bush Presidential Library and Museum in College Station, Texas, where he is buried.

The stamp will feature a portrait of Bush painted by artist Michael J. Deas, based on a 1997 photo taken by Timothy Greenfield-Sanders, according to the USPS.

The stamp will be available for pre-order April 6, for delivery on or after its June 12 release.

Bush, the 41st president of the United States, died Nov. 30 at 94 years old.

The USPS said the stamp is being issued as a "forever" stamp, which means it will always be equal to the current value of first-class mail, 1-ounce price.

Man Arrested for Running Over Resident Twice in East Haven

A man was arrested in East Haven after a dispute prompted violence in a condominium parking lot in East Haven, police said.

A man was hit by another man's car twice before police arrived on scene and noticed him laying in the parking lot with non-life threatening injuries, police said.

The victim told police that he and Breezewood Condominium's unofficial maintenance man, 61-year-old Gary Gambardella, got into a verbal argument about doing unauthorized work on the roof.

The argument between the victim and Gambardella continued into the condo's parking lot and turned violent when Gambardella got into his car and knowingly backed into him, the victim told police.

The victim told police he was dragged briefly by Gambardella who was attempting to leave the parking lot. The victim said that he managed to free himself and ran back towards Gambardella’s car to try to prevent him from leaving. He was then hit again and flung into the air, he told police.

Police said several witnesses confirmed the chain of events that took place.

The man was taken to Yale New Haven Hospital on Saturday for further evaluation, according to police.

Gambardella was arrested and charged with first degree assault, first degree reckless endangerment and evading responsibility.

Police said Gambardella was released on a $50,000 bond and is scheduled to appear in court on April 17.

Buttigieg Describes Struggle With Sexual Orientation

Pete Buttigieg may not become president or win the Democratic primary, but he's already broken a barrier by delving publicly and intimately into his struggle with his own sexuality in a way no other serious presidential candidate has, NBC News reports.

In a speech before an audience of LGBT rights supporters on Sunday, the mayor of South Bend, Indiana, did not describe being gay as something he always believed was acceptable. Instead, he described wrestling with his sexual orientation as “a kind of war” — one he said he was only able to win when he came home from serving in Afghanistan. 

“If you could have offered me a pill that could make me straight, I would have swallowed it before you could give me a swig of water,” Buttigieg said at the LGBTQ Victory Fund’s annual brunch. “It’s a hard thing to think about now. If you had shown me exactly what it was that made me gay, I would have cut it out with a knife.”

He added later: “Thank God there was no pill. Thank God there was no knife.”

Police Investigate After Manchester Accident That Resulted in Multiple Injuries

Manchester Police are investigating after a motor vehicle accident resulted in multiple injuries.

A motorcycle reportedly struck a car near the intersection of Camp Meeting Road and Birch Mountain Road, police said.

Police said the driver and the passenger of the motorcycle were both taken to the hospital with serious, but non-life threatening injuries. The driver of the car was also brought to the hospital with non-life threatening injuries.

The Manchester Police Traffic Unit was called to the scene to investigate.

Silver Alert Issued for 85-Year-Old Man Missing From Branford

A Silver Alert has been issued for an 85-year-old man who was reported missing from Branford on Sunday.

Robert Mcgan is believed to be driving a 2003 Toyota Camry from Massachusetts with the license plate 85HM55.

Police said Mcgan is bald and has hazel eyes. He is 5'08" and weighs about 165 pounds.

Anyone with information is asked to call Branford Police at 203-481-4241.

Cho Yang-Ho, Embattled CEO of Korean Air, Dies at 70

Cho Yang-ho, the chairman and chief executive of Korean Air whose legal troubles — and colorful daughters — kept him and the airline in an unwanted spotlight, died Sunday, the airline said.

NBC News reported that Cho, who was under indictment in South Korea on suspicion of embezzlement and of having steered lucrative contracts to companies run by his family, died in a Los Angeles hospital from an illness that the airline didn't identify.

Cho was ousted from Korean Air's board last month as the scandal mushroomed. He kept his positions as chairman and chief executive of the airline and its parent company, Hanjin Group.

'We'll Keep Praying': Fires Burn 3 La. Black Churches

After three century-old African American churches in one Louisiana parish burned down within 10 days, hundreds of investigators are probing what sparked the blazes and churchgoers are trying to pull together, NBC News reported.

"It's sad that our society has stooped this low to do something like that," said Mount Pleasant Baptist Church Pastor Gerald Toussaint Sunday as he surveyed the charred remains of the building.

The congregation was invited to a nearby church, where morning service on Sunday was packed as Deacon Curtis Zachary said, "Let them know we'll keep praying with a building or without a building."

Louisiana State Fire Marshal Butch Browning called the fires suspicious. He is leading the probe to determine the their cause, working with FBI and ATF investigators across the country.

NASA Climate Scientist Behind 'OMG' Study Moonlights as Comedian

Climate change can be a difficult topic to explain and understand, but one NASA scientist has found a funny way to talk about the issue.

Josh Willis is a climate scientist at NASA's Jet Propulsion Laboratory.

"I study global warming and rising oceans and how the oceans affect our weather and climate," Willis says with pride.

But science isn't his only passion.

"My night job is comedy," Willis says with a smile.

He jokes to the camera, "I try not to tell my coworkers, so if you could just not broadcast this when we're done, that would be really great." 

After getting his doctorate in oceanography from Scripps Institute in San Diego, Willis decided to sign up for comedy school.

"I wanted to make global warming funny because I think people will have an easier time relating to it and understanding it if they can have a laugh every now and then," he says.

He's a graduate of the Second City Comedy School, a prestigious improv comedy program that was the launching pad for legends like Bill Murray, Steve Carell, and Tina Fey.

He realized that comedy and climate have a lot in common.

"Being a scientist, we're trying to discover something about the world, and I think being a comedian, you're trying to discover something about people that makes them laugh," Willis says. 

One way to communicate climate change was to develop a character that people could relate to, so the scientist turned to the "King of Rock and Roll."

"Being a kind of a middle-age doughy, white guy with big hair and sideburns, Elvis seemed like the perfect guy," Willis explains the choice.

His strategy is working, and has more people interested, even if it means they realize that climate change is no laughing matter.

Willis adds, "When I tell somebody that I'm a climate scientist, one of the first things they ask is 'is it real?' 'How bad is it?' And I think it's helpful to have a friendly conversation first because we are having a profound impact on the planet."

Willis is currently leading a mission called Oceans Melting Greenland or OMG for short.

The comedian scientist explains, "I really wanted to name the mission something that was funny and memorable, but I also wanted to name it something that said what science we were doing, and Oceans Melting Greenland, those three words explain exactly what we are trying to find out."

Until Hollywood comes calling, Willis plans to keep his day job, but connecting people to climate change while making them laugh out loud is a nice side gig.

"It's a tough thing to communicate, and I think that we need to use all the tools that we can in order to really reach people and help them understand what's happening to the planet," he says.

The OMG team is heading back to Greenland next week to finish measuring how the glaciers have changed since last year. As for Willis, he says he hopes to someday make a movie about global warming with Will Ferrell.

In Act of Kindness, Activists Offer Water, Comfort at Calif. Pig Vigils

About two times a week for the last two years, people have gathered outside Farmer John in Vernon with water, comforting words and sometimes a calming and gentle touch for the truckloads of pigs bound for slaughter at the processing plant south of downtown Los Angeles.

The deeply emotional vigils, often in the cool darkness of night, draw mostly vegans and some vegetarians. Some of the Vernon police officers assigned to patrol outside the building said they've given up meat because of what they've seen. 

"All these people are here to show them the first kindness they've ever experienced," said Shelby Hammond, who attended a recent vigil. 

The activists usually have just a few minutes with the pigs before the trucks are ready to pull into Farmer John. In a solemn ritual that plays out several times each night, they line up alongside the trailers and hold water bottles up to holes — offering a final drink from a water bottle or sprayer and some soothing words, sometimes a soft pat. 

Many are in tears as the gate opens and the truck rolls away onto the property. 

The exterior wall of the Vernon building is painted with depictions of pigs on a farm, a mural that has been there since the late 1950s. Farmer John's roots date to 1931, when two brothers began curing and selling pork bellies and smoked hams to grocery stores. The company run by the Clougherty family was renamed Farmer John in 1953.

Smithfield foods acquired Farmer John in 2016. In a statement, the company said it respects that the group can express its views, and that the vigils do not impact operations.

"At Smithfield Foods, we respect the rights of groups and individuals to express their views," the company said in a statement. "This includes the peaceful protests that regularly occur outside our Vernon, California, Farmer John processing facility. The group involved has been conducting these protests long before Smithfield acquired Farmer John in 2016.

"During any demonstration, Smithfield works with local law enforcement and protest leaders to ensure the safety of the protestors, our employees, our animals, and the public. Because of these coordinated efforts, the public demonstrations do not impact Farmer John’s production process or our ability to serve our customers and consumers."

The vigils, which began in 2017, are organized by Amy Jean Davis, of LA Animal Save, and Ellen Dent, of Animal Alliance Network. They draw people from throughout Los Angeles, sometimes attracting celebrities like musician and animal rights activist Moby.

"It's a life-changing, profound experience," he said.

YouTuber Elton Castee was attending one for the first time, recording for an upcoming video. 

"It’s different when you see a video of it," Castee said. "It’s through a lens, but when you actually see it in your eyes, it's not one truck. It’s two, three, four. The first was heart-breaking."

Moby had some advice for anyone moved by what can be a powerful experience.

"Don't let the pursuit of the perfect be the enemy of the good," he said. "If someone is watching, do the best you can and let your conscience guide your actions."

If potential Winner cannot be reached, is found to be ineligible, cannot or does not comply with these Official Rules, or if Prize or prize notification is returned as undeliverable, potential Winner will be disqualified and time permitting, at Sponsors’ sole discretion, an alternate potential Winner may be selected from the remaining eligible Entries.

PRIZE: There will be one (1) prize (“Prize”) awarded to Winner. Prize will consist of a trip to Las Vegas, NV for Winner and one (1) guest (“Guest”) to the 2019 Billboard Music Awards (“Trip”).

Trip includes: two (2) fan zone passes (Winner and Guest will be able to walk the red carpet before it opens and experience arrivals firsthand in the red carpet fan pit) plus show tickets for Winner and Guest to the 2019 Billboard Music Awards on Wednesday, May 1, 2019 (“Event”); Round-trip Main-Cabin-Class air transportation for two (2) on Delta Air Lines or its “Airline Associates” (Delta Shuttle, Delta Connection) for travel between the closest city to the Winner’s residence served by Delta Air Lines or its Airline Associates and Las Vegas, NV; double occupancy hotel accommodations for two (2) nights (one room, room rate, taxes and resort fee only) at the MGM Grand; and funds in the amount of one hundred dollars ($100) for transportation to and from the airport in Las Vegas, NV. Guest must be at least thirteen (13) years old (as of the first date of travel). If Guest is a minor, Winner must be such minor’s parent or legal guardian. PRIZE DOES NOT INCLUDE ACCOMMODATIONS, PARKING OR TRANPSORATION OUTSIDE OF THAT DESCRIBED ABOVE.

Estimated Retail Value (“ERV”) of Prize is two thousand, four-hundred dollars ($2,400). Actual Retail Value (“ARV”) of Prize may vary. Any difference between stated ERV and ARV will not be awarded.

All details of Prize will be determined by Sponsors in their sole discretion. Sponsors reserve the right to substitute a similar Prize (or Prize element) of comparable or greater value. All taxes and other expenses, costs, or fees associated with the acceptance and/or use of Prize are the sole responsibility of Winner. Prize cannot be transferred by Winner or redeemed for cash and is valid only for the items detailed above, with no substitution of Prize by Winner. If Prize is unclaimed within a reasonable time after notification from Sponsor, as determined by Sponsors in their sole discretion, it will be forfeited, and time permitting, an alternate Winner may be selected from the remaining eligible entries at Sponsors’ sole discretion. Winner must be at least twenty-one (21) years old as of the first date of travel. Guest must be at least thirteen (13) years old (as of the first date of travel), and if Guest is a minor in Winner’s state, Winner must be the parent or legal guardian of Guest.

Winner and guest must be able to travel between April 30, 2019 and May 2, 2019 (or on such other dates designated by Sponsors), or the Prize will be forfeited. Travel arrangements must be made through Sponsors’ or Prize Provider’s agent on a carrier of Sponsors’ choice. Certain travel restrictions and blackout dates may apply. Sponsors have the right in their sole discretion to substitute ground transportation for air transportation depending on Winner’s place of residence. Winner and Guest(s) must travel together on the same itinerary, including the same departure date, destination, and return date, and must have valid travel documents (e.g., valid government issued photo ID and/or passport) prior to departure, and failure to do so will result in forfeiture of Prize. Sponsors will not replace any lost, mutilated, or stolen tickets, travel vouchers, or certificates.

Once travel commences, no unscheduled stopovers are permitted; if an unscheduled stopover occurs, full fare will be charged from stopover point for the remaining segments, including return, of the trip. Sponsors are not liable for any expenses incurred as a consequence of flight cancellation/delay. Trip may not be combined with any other offer, and travel may not qualify for frequent flyer miles. All travel and lodging will be at the risk of Winner and Guest. Winner is solely responsible for all expenses and costs associated with acceptance and/or use of Prize not specifically stated herein as being awarded, including, without limitation, any and all taxes and other expenses, costs, or fees associated with the acceptance and/or use of Prize, travel insurance, ground transportation (other than as described above), security and airport fees, baggage fees (both checked and carry on), premium seat fees, taxes, insurance, gasoline, meals, gratuities, additional hotel amenities (e.g., spa services, internet access, phone calls, laundry services), and souvenirs. Sponsors shall have the right, but not the obligation, to make any deductions and withholdings that Sponsors deem necessary or desirable under applicable federal, state and local tax laws, rules, regulations, codes or ordinances.

Sponsors shall have no responsibility or liability for cancellations, delays, or any other change by any company or person providing any element of Prize due to reasons beyond Sponsors’ control and are not responsible or liable for any expenses incurred as a consequence thereof. Date and/or time of Event are subject to change. Event is subject to cancellation. If Winner chooses to attend the Event with no Guest, the remaining elements of Prize shall constitute full satisfaction of Sponsors’ Prize obligation to Winner, and no additional compensation will be awarded. Guest, if any, may be required to execute and return releases of liability and, where legal, publicity releases (collectively, “Guest Documents”), which must be returned with the Sweepstakes Documents, or Guest portion of the Prize will be forfeited. Guest must be at least thirteen (13) years old (as of the first date of travel). If Guest is a minor, Winner must be such minor’s parent or legal guardian and must execute and return the Guest Documents on such minor’s behalf.

Winner and Guest(s) must comply with all of the rules and regulations of the venue where the Event is held. Winner acknowledges that if Winner and/or Guest behaves in a disorderly or disruptive manner or with intent to annoy, abuse, threaten, or harass any other person at the Event, Winner and/or Guest may be removed from the venue or denied entry (as determined by producer of the Event, the venue, or their designee(s) in their sole and absolute discretion). By accepting any ticketed portion of the Prize, Winner agrees to abide by any terms, conditions, and restrictions provided by the ticket. Winner and Guest also agree to comply with the “Delta Vacations Terms & Conditions” listed below in connection with Winner’s and Guest’s use of the Prize.

Delta Vacations Terms & Conditions:

a. The trip certificates are non-­‐refundable and non-­‐transferable.

b. Tickets issued in conjunction with this promotion have zero cash value.

c. Airfare is not included unless otherwise specified. For certificates which specify the inclusion of airfare: Delta Vacations will provide air transportation via Delta Air Lines from any city in the U.S. 50 or Canada. Travel is permitted on designated flights operated by Delta Air Lines; the Delta Connection® carriers: Compass Airlines, GoJet Airlines, Endeavor Air, Shuttle America, and SkyWest; and Delta Shuttle® carriers: Shuttle America and Compass Airlines. Travel via other DL Airlink and DL designated affiliated partner flights is not permitted. The recipient shall be responsible for travel to and from the airport served by such flights.

d. Not valid with previously purchased trip. Trip certificate may not be combined with any other coupon, certificates, discount, bonus, infant fare, upgrade, SkyMiles Air Travel Award or promotional offers/tickets.

e. Trip certificates are not valid with Miscellaneous Charge Orders or Prepaid tickets.

f. Trip certificates cannot be sold or transferred. Purchased certificates are subject to confiscation and you will not be allowed to travel. Only original certificates will be accepted. Certificates will not be replaced. Void if altered.

g. Travel must be roundtrip.

h. Reservations must be made and ticket issued prior to departure.

i. Delta Vacations must make all reservations and issue all travel documentation.

j. Each certificate may only be applied towards one passenger and one guest.

k. Any unused portion of the certificate will not be refunded, and cannot be used towards another booking or another service component.

l. Travel agent commission is not paid/earned on a free trip.

m. State and federal income taxes may apply and are the sole responsibility of the recipient.

n. Checked luggage fees may apply and are the sole responsibility of the recipient. Fees are charged each way, and are subject to change. Refer to delta.com for current rates.

o. Changes to reservations, once made, are not permitted.

p. A per ticket surcharge will apply for paper tickets issued in markets where electronic ticketing is available.

q. Substitutions will not be allowed.

r. Space is subject to availability

s. The individual redeeming each certificate must be 21 years of age or older

t. SkyMiles mileage credit and/or MQDs may or may not be awarded.

u. Flight schedules are subject to change without notice.

v. Delta Vacations is the final authority on the interpretation of these terms and conditions and reserve the right to change these terms and conditions without prior notice.

w. Standard Delta Vacations Terms and Conditions apply, and are outlined during the booking process; other airline restrictions may apply.

x. Certain destinations may charge taxes or fees not covered by this certificate or Delta Vacations.

CONDITIONS: By entering the Sweepstakes, each entrant agrees for entrant and for entrant’s heirs, executors, and administrators (a) to release and hold harmless Sweepstakes Entities, Facebook, and each of their respective officers, directors, and employees (collectively, “Released Parties”) from any liability, illness, injury, death, loss, litigation, or damage that may occur, directly or indirectly, whether caused by negligence or not, from such entrant’s participation in the Sweepstakes and/or his/her acceptance, possession, use, or misuse of Prize or any portion thereof (including any travel related thereto); (b) to indemnify Released Parties from any and all liability resulting or arising from the Sweepstakes and to hereby acknowledge that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to Prize, including express warranties provided exclusively by Prize Provider that are sent along with Prize; (c) if selected as a Winner, to the posting of such entrant’s name on Website and the use by Released Parties of such name, voice, image, and/or likeness for publicity, promotional, and advertising purposes in any and all media now or hereafter known, throughout the world in perpetuity, without additional compensation, notification, permission, or approval, and, upon request, to the giving of consent, in writing, to such use; and (d) to be bound by these Official Rules and to waive any right to claim any ambiguity or error therein or in the Sweepstakes itself, and to be bound by all decisions of the Sponsors, which are binding and final. Any attempt to deliberately damage the Sweepstakes or the operation thereof is unlawful and subject to legal action by Sponsors, who may seek damages to the fullest extent permitted by law. The failure of Sponsors to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of Sponsors (excepting compliance with applicable codes and regulations), or other “force majeure” event will not be considered a breach of these Official Rules. Released Parties assume no responsibility for any injury or damage to entrants’ or to any other person’s computer relating to or resulting from entering or downloading materials or software in connection with the Sweepstakes. Released Parties are not responsible for telecommunications, network, electronic, technical, or computer failures of any kind; for inaccurate transcription of entry information; for errors in any promotional or marketing materials or in these Official Rules; for any human or electronic error; or for entries that are stolen, misdirected, garbled, delayed, lost, late, damaged, or returned. Sponsors reserve the right to cancel, modify, or suspend the Sweepstakes or any element thereof (including, without limitation, these Official Rules) without notice in any manner and for any reason (including, without limitation, in the event of any unanticipated occurrence that is not fully addressed in these Official Rules). In the event of cancellation, modification, or suspension, Sponsors reserve the right to select Winner in a random drawing from among all eligible, non-suspect entries received prior to the time of the event warranting such cancellation, modification, or suspension. Notice of such cancellation, modification, or suspension will be posted on the Website. Sponsors may prohibit any entrant or potential entrant from participating in the Sweepstakes, if such entrant or potential entrant shows a disregard for these Official Rules; acts with an intent to annoy, abuse, threaten, or harass any other entrant, Sponsors, or Sponsors’ agents or representatives; or behaves in any other disruptive manner (as determined by Sponsors in their sole discretion). Sponsors reserve the right to modify these rules for clarification purposes without materially affecting the terms and conditions of the Sweepstakes.

DISPUTES: THE SWEEPSTAKES IS GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF NEW YORK, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE IN NEW YORK, NEW YORK. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., IN ACCORDANCE WITH ITS STREAMLINED ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF (“JAMS RULES”). THE JAMS RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED AND LICENSED TO PRACTICE LAW IN NEW YORK. ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH WILL BE CONDUCTED IN THE COUNTY OF NEW YORK. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEY’S FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF.
