Asylum Seeker, a 'Victim of Torture,' Facing Deportation

When José Antonio Hernández Viera was awakened early Friday morning, he and his belongings were stuffed into a vehicle and driven away from Pine Prairie ICE Processing Center. The 40-year-old Cuban asylum seeker had hoped to leave immigrant detention in Louisiana. But not like this.

He texted photos to his wife Angela Mairielys Lazo Torres from the car, with chains visible in the frame. “I’m desperate — ready to scream — not only because of what could happen to him but also because he can’t fly,” she texted NBC.

Only a week before, Dr. Allen Keller, an associate professor of medicine at the New York University School of Medicine and co-founder of the Bellevue/NYU Program for Survivors of Torture, had evaluated Hernández Viera in Louisiana. After more than 12 hours of evaluations over the phone and in-person, he had declared, under penalty of perjury, that deporting the asylum seeker to Cuba “poses an imminent threat to his life.”

“Standards of humanity, common decency and medical necessity warrant that Mr. Hernandez Viera should immediately be released from immigration detention and allowed to rejoin his family,” Dr. Keller wrote.

At the time of evaluation, Hernández Viera was unable to walk without a walker. He was barely a week out of hip replacement surgery, after which he said he experienced inadequate medical treatment back at Pine Prairie — including being left overnight in a wheelchair and trying not to eat because he was afraid no one would help him use the toilet.

Dr. Keller wrote it was “crucial” for Hernández Viera to be released from detention. Instead, he was loaded into a vehicle and driven to Houston, where he is awaiting deportation.

U.S. Immigration and Customs Enforcement has previously said he is unlawfully present and "received all appropriate legal process" before being ordered removed.

“I don’t have any idea what’s going to happen or what we will be able to do to reunite as a family again,” Lazo Torres texted Monday night.

Hernández Viera, his wife and their 3-year-old daughter fled Cuba after alleged persecution because of his political opinions. He was reportedly detained multiple times and beaten once in front of his family; Dr. Keller believes he was “a victim of torture.”

Lazo Torres and her two daughters, including the 3-year-old, came to the U.S. before Hernández Viera and were released from detention. They’re now living in Florida and Lazo Torres is on the road to becoming a legal permanent resident.

Meanwhile, despite having no criminal convictions, establishing a credible fear of persecution in his home country, and having a sponsor in the United States, Hernández Viera was held in Department of Homeland Security custody for more than a year as he pursued his case. A judge with a recent 83.8% asylum denial rate found that he had not met the burden of proof to be granted asylum, and months later his appeal was denied.

“I was dumbfounded reviewing his case and talking to him about what happened to him that he lost his asylum claim,” Dr. Keller said.

The Southern Poverty Law Center — which took on his parole request last year to try to get him out of detention while he awaited his immigration hearing — has exhausted every possible legal option to stop his deportation, according to Laura Rivera, an SPLC attorney. They worked with a volunteer attorney to request a stay of his removal, which was denied. They rallied to file a habeas petition — originally intended for a Louisiana district court — in Texas, claiming his detention was unlawful because of lacking medical care.

“Despite all that, ICE is still planning to put him on a plane tomorrow when he can’t even walk on his own,” Rivera said.

On Monday, a judge in the Southern District of Texas ordered ICE to provide Hernández Viera with 30 days worth of medication, a wheelchair and a walker, Rivera said. But the judge did not order his release.

Now, as Hernández Viera stares down removal as soon as Tuesday, his wife says she doesn’t know what will happen to him — but she knows he won’t be treated well.

“He’s a traitor to them,” she said of the Cuban government.

“What am I going to say to my 3-year-old baby?” Lazo Torres added. “How am I going to explain that I don’t know when we’ll be with her daddy again?”

Hernández Viera’s last opportunity to remain in the U.S. hinges on congressional intervention, according to Rivera. For months, Lazo Torres has appealed to Sen. Marco Rubio, a Cuban American from Florida whose own relatives were admitted into the U.S. as refugees. When asked what Rubio has done to help her, Lazo Torres replied “absolutely nothing.”

“Our office is aware of the situation and we have had numerous communications with Mrs. Lazo Torres, including as recently as last week,” said a spokesperson for Sen. Rubio.

Since Hernández Viera was removed from Pine Prairie on Friday, advocates have reached out to other members of Congress from around the country to plead for intervention. A few senators' offices are inquiring into the matter, Rivera said, but she has not heard of any positive developments.

Hundreds of US Hospice Centers Get Failing Grades

Hundreds of hospice care facilities across the country were found to have serious, life-threatening deficiencies, according to an investigation by the Department of Health and Human Services Office of Inspector General and obtained by NBC News.

Severe complaints were lodged over unsanitary conditions at some facilities, and over patient wounds that were badly treated or not treated at all at others.

More than 300 hospice facilities out of the 4,563 surveyed nationwide between 2012 and 2016 were considered poor performers, according to the IG’s report.

Firefighters Battle 2-Alarm House Fire Overnight in Andover, Mass.

An Andover, Massachusetts home was deemed a total loss following a 2-alarm fire that burned through the night.

The blaze was reported sometime before 11 p.m. Monday at a house on 8 Brundrett Ave., according to the State Fire Marshal.

Aerial footage from NBC10 Boston’s Sky Ranger helicopter captured several units responding to the fire. Extensive damage can be seen on the roof of the home.

No injuries occurred in connection to the blaze. The cause of the fire is under investigation.

Police Investigation Underway in Windsor

A police investigation is underway in Windsor on Tuesday morning.

Authorities said the investigation is on Windsor Avenue, also known as Route 159.

According to officers at the scene, they are searching for a person. They did not give details as to who they are searching for or what may have happened.

A vehicle could be seen taped off in a home's yard.

'Forky' Toy From 'Toy Story 4' Gets Recalled for Its 'Googly' Eyes

Looks like "Forky" is destined for the garbage can after all. 

Disney has recalled a plush toy depicting the "Toy Story 4" character Forky  because the spork's plastic rolling "googly" eyes "can detach, posing a choking hazard to young children." 

The recall affects about 80,000 units of the 11-inch toy in the United States, as well as about 650 in Canada, a notice Monday by the U.S. Consumer Product Safety Commission said

No injuries have been reported but Disney says parents should snatch the toy away from their children and return Forky for a refund to any Disney Store retail location, including those at Walt Disney World or Disneyland theme parks. 

The $20 made-in-China Forky toys, which have poseable arms and rainbow art on the top of a foot, were sold at Disney stores, online through shopdisney.com and via the Disney store on Amazon Marketplace from April to June. 

Forky is a central character in Disney Pixar's "Toy Story 4," who comes to life after child Bonnie crafts him from a spork. He initially believes he's trash, not a toy, and repeatedly tries to flee to the safety of a garbage can. Forky is voiced by Tony Hale in the movie, which was released in June. 

Consumers wanting more information on the recall can call Disney toll-free at (866) 537-7649 from 7 a.m. to 9 p.m. CT on weekdays, Saturday from 8 a.m. to 4:30 p.m., and Sunday 1:30 p.m. to 9 p.m.

'Be Gone, Girl': Fotis Dulos Lawyer Responds to Comments

The attorney for Fotis Dulos has a simple message for author Gillian Flynn: "Be gone, girl."

Norman Pattis made the comments after the "Gone Girl" scribe said she was "absolutely sickened" by the suggestion that missing Connecticut missing mother Jeniffer Dulos could have staged her own disappearance in a revenge scheme to frame her estranged husband. 

While he complimented Flynn's novel, which was later turned into a major motion picture, as "the best book I've ever read on the misleading nature of circumstantial evidence," that's about as far as the niceties went for the writer.

"(Flynn) made a fortune in royalties from the book and movie adaption. Just how her fictional aptitude translates into expertise in an actual criminal case is an even greater mystery, however," Pattis said in a statement to News 4. "Candidly, Gillian’s ignorant fulminations about the Dulos case play to the very impulses she exploited in her book."

Pattis finished his statement with a direct shot right at Flynn: "So here’s a message to Gillian: Be gone, girl. There’s serious work to be done here. This isn’t fiction. It’s reality."

No one has seen the New Canaan mother of five since May 24, when she dropped her children off at school. An attorney for her estranged husband, Fotis Dulos, who has pleaded not guilty to evidence tampering and hindering prosecution in her case, posited a theory that Jennifer Dulos faked her disappearance like a character in Flynn's best-seller.

At the time, the attorney, Norm Pattis, cited a "very dark 500-page plus novel" that Jennifer Dulos had written. 

Flynn said in a statement to NBC News Saturday that she had seen the recent coverage, including Pattis' reference to her own novel. And she was horrified.

"It absolutely sickens me that a work of fiction written by me would be used by Fotis Dulos's lawyer as a defense, and a hypothetical, sensationalized motive behind Jennifer's very real and very tragic disappearance," she told NBC News.

Jennifer Dulos' family was quick to dismiss Pattis' theory as well, saying shortly after he stated it publicly that the claim was "false and irresponsible" and that Jennifer Dulos' novel had been written well before Flynn's work. The family also said the missing mother's novel was not a mystery tome.

"This is not fiction or a movie. This is real life, as experienced every single day by Jennifer’s five young children, her family, and her friends. We are heartbroken," according to the statement released in late June. 

State, local and federal investigators have been scouring multiple states for any sign of Jennifer Dulos. Her blood and her husband's DNA were found mixed on a kitchen faucet, and Fotis Dulos and his girlfriend were allegedly seen dumping garbage -- some that included Jennifer's clothes and had blood on them -- multiple times on a 4-mile stretch of road in the Hartford area -- but both Fotis Dulos and his girlfriend have denied any involvement in her disappearance.

In his first interview last week, Fotis Dulos exclusively told News 4 that he knows what the public thinks of him, and has a message: Wait until the facts come out.

"I know what I've done, I know what I haven't done," Fotis Dulos said. "I have to stand and fight and hope the truth is going to come out."

Attorney: Toddler Died After Falling From Open Window in Ship's Play Area

The family of an 18-month-old toddler who fell to her death from the 11th story of a Royal Caribbean cruise ship wants answers as to why there was an open window in the glass paneling near the children's play area. 

Chloe Wiegand was traveling with her parents, two siblings and two sets of grandparents aboard the Freedom of the Seas, which docked in Puerto Rico on Sunday after a weeklong trip through the Caribbean. The death occurred Sunday afternoon at the Panamerican dock in the capital of San Juan.

Chloe was playing on the ship's H2O Zone kids water park, accompanied by her maternal grandfather, Salvatore Anello, family attorney Michael Winkleman told NBC News. They often played together – at home in Indiana, at parks and at Chloe's brother's hockey games, Winkleman said.

A similarity between those days at hockey rinks and that day in the kid's area of the cruise is what led to the tragedy, according to the Winkleman.

Chloe loved cheering on her brother at his games – slamming on the hockey rink's glass panels.

Winkleman said Anello recounted through tears that Chloe wandered towards the glass wall and asked to be lifted up. Anello lifted Chloe and placed her on a railing that he believed was behind glass, not realizing there was a "hidden danger."

"Essentially, her grandfather lifts her up and puts her on a railing and where he thinks that there is glass there because it's clear, but it turns out there was no glass there," Winkleman said. "She goes to bang on the glass like she would have at one of those hockey rinks and the next thing you know, she's gone."

Winkleman, a maritime lawyer at the Lipcon, Margulies, Alsina & Winkleman firm, said witnesses described hearing a "blood-curdling scream" after Chloe fell over.

He said Chloe's parents, Alan and Kimberly Wiegan, are devestated. The family, which is still in San Juan, wants the world to know "how loving and positive" Chloe was.

"The family is really at a loss for words. They are so deeply and utterly devastated by what happened," Winkleman said. "I think they are really trying to remain positive."

In a downtown Miami press conference on Tuesday, Winkleman said the incident was "preventable."

Winkleman said though he feels there are grounds for a lawsuit, he wants his firm to look at video of the incident first. The law firm and Royal Caribbean are discussing possibly releasing the video. If so, it is not clear if the video would be released to the public.

The family also wants answers on the open glass window, Winkleman said, and if no good answers are provided, then Royal Caribbean is "on the hook," he added.  

"I'm just left wondering why in the world would you have an open window in a wall full of glass, literally right next to a kid's area?" Winkleman said.

Puerto Rico Ports Authority spokesman José Carmona told The Associated Press officials are investigating whether the window was already opened or if someone had opened it.

A Royal Caribbean Cruises spokeswoman said the ship departed Puerto Rico on Monday for St. Maarten on a new itinerary and declined further comment.

Chloe's body is expected to be released to the family on Tuesday, Winkleman said.

Police ID Bristol Man Killed in Rollover Crash in Avon

Police have identified the man who was killed after a rollover crash in Avon on Friday night.

Officers were called to a rollover crash on Waterville Road shortly before 7:30 p.m.

When crews arrived, they said they found a 2002 black Dodge Durango that had gone over the guardrail and went down a steep embankment, stopping by the wood line.

The vehicle was not occupied when it was found, according to police.

Officers used thermal imaging and found the driver, later identified as 41-year-old Steven S. Ouellette, of Bristol, in the woods unresponsive with severe trauma to his head and upper body.

Ouellette was transported to UConn Medical Center, where he later died.

The North Central Municipal Accident Reconstruction Squad responded and is investigating the crash.

New York City will hold a ticker-tape parade to celebrate the U.S. women's soccer team's World Cup victory Wednesday, marking the second time that the honor will be bestowed upon female athletes.

Here are the answers to a handful of common questions about the parade.

What is the parade route?

The parade will take place along "The Canyon of Heroes," traveling east on Battery Place to Broadway, turning north on Broadway, turning east on Worth Street, then south on Lafayette Street and conclude at Chambers and Centre streets.

What is the time of the parade?

The parade kicks off at 9:30 a.m. A special ceremony at City Hall Plaza will follow at 10:30 a.m.

How can I watch the parade?

If you can't watch the parade in person, don't worry. We've got you covered. NBC 4 New York will air full TV coverage of the event and will stream all the action on this website.

How many people does the Plaza hold?

It holds more than 3,500 people.

What streets will be closed?

The NYPD will begin street closings on Broadway and the surrounding area and the surrounding area at approximately 6 a.m. before the parade starts. "No Parking" will be in effect beginning at 12 a.m. Wednesday. Any cars remaining will be towed.

The Brooklyn Bridge (Manhattan Bound) Centre Street exit will be closed for the duration of the parade. The Park Row entrance to the Brooklyn Bridge will also be closed during this time. Those looking for access to the Brooklyn Bridge should use the Frankfort Street/Pearl Street entrance, the city says.

Deliveries will be restricted for all businesses and residences in the area beginning 10 p.m. Tuesday and will not resume until Wednesday 5 p.m.

What about train and bus services?

The MTA will have train service changes, and may close certain subway entrances and exits in the area. Due to street closures, many MTA buses may be re-routed. Head to the MTA website for details.

Where does the confetti come from?

Crews Investigate Cause of Granby House Fire That Injured 1 Person

One person is injured after a house fire in Granby on Tuesday morning and police have closed a road while crews work to get it under control.

Police said crews were called to Lost Acres Road around 8:20 a.m. after getting a report of a house fire.

When officers arrived, a single-family home was fully involved in fire and the resident was able to escape on his own, authorities added. He sustained a very minor hand injury, police said.

Firefighters were forced to fight the fire from the exterior of the home because police said there was what sounded like ammunition and possibly fuel tanks with propane inside the house that were cooking off.

"There was obviously some type of material cooking off in the fire, making a great deal of noise so we had to keep the safety perimeter and then the fire department was limited to external operations," said Granby Police Captain William Tyler.

Multiple other departments were called to help fight the fire.

Lost Acres Road is currently closed. There is no word on when the road will reopen.

The cause of the fire remains under investigation.

Former Presidential Candidate, Texas Billionaire H. Ross Perot Dies at 89

Henry Ross Perot, best known for his run as an independent candidate in the 1992 presidential campaign, died Tuesday at his home in Dallas, NBC 5 has confirmed. He was 89 years old.

The Texas businessman was born in Texarkana in 1930 and graduated from Texas High School in 1947. After high school, Perot attended Texarkana Junior College and then entered the U.S. Naval Academy in 1949.

After Perot left the Navy in 1957, he went to work for IBM as a salesman. Then in 1962 he left IBM and founded Electronic Data Systems (EDS) in Dallas. EDS went public in 1968 and the stock price rose from $16 a share to $160 a share within a few days.

Perot was featured on the 1968 cover of Fortune Magazine as the "fastest, richest Texan."

General Motors would later buy a controlling interest in EDS for $2.4 billion.

In 1988, Perot founded Perot Systems Corporation, Inc. in the Dallas suburb of Plano. His son, Ross Perot Jr., succeeded him as CEO and in 2009 Perot Systems was eventually acquired by Round Rock-based computer technology company Dell for $3.9 billion.

It was in 1992 that Perot announced his intention to run as an independent for President of the United States. He spent $12.3 million of his own money to finance his run.

During a presidential debate in the 1992 race opposite George H.W. Bush and Bill Clinton, Perot scored a major laugh line with a nod to his appearance.

"We've got to clean this mess up, leave this country in good shape, and pass on the American dream to them. We've got to collect the taxes to do it. If there's a fairer way, I'm all ears," he said, before the audience erupted with applause.

In the end, Perot received 18.9% of the popular vote, but no electoral college votes, which made him the most successful third-party presidential candidate since Theodore Roosevelt in the 1912 election.

Perot ran again in 1996, but was once again unsuccessful, receiving only 8% of the popular vote.

Just four days before the 2000 election, Perot made an appearance on Larry King Live and endorsed George W. Bush for president, saying he was unhappy with what he had seen from the Reform Party.

Since that time, Perot has remained mainly silent on political issues.

Perot is survived by his wife, Margot; his sister, Bette Perot; son Ross Jr. and his wife Sarah Perot; daughter Nancy and her husband Rod Jones; daughter Suzanne and her husband, Patrick McGee; daughter Carolyn and her husband Karl Rathjen; daughter Katherine and her husband Eric Reeves; grandchildren Hill, Hunter, Sarah Catherine (and her husband Reed Ruschhaupt) and Meredith Perot; Ross (and his wife Tori), Price, Ben and Clayton Mulford; Patrick, William, Margot and Cameron McGee; Henry and Bette Rathjen; Kate Flanagan and Stuart Reeves; and three step-grandchildren Elizabeth Reeves and Caroline and Will Jones.

In May 2008, the five Perot children donated $50 million to the fund-raising campaign to build the new Victory Park location of Dallas' Museum of Nature & Science in honor of their parents. When the new location opened in 2012, it was named the Perot Museum of Nature and Science in the family's honor.

"In our country, you can dream the dream and make the dream come true," Perot said when the museum opened. He continued, "Honored that my children and grandchildren wanted to do this. And I hope it will inspire young people to reach for the stars, as I was able to do."

Funeral arrangements have not yet been announced.

The family asked that memorial contributions to be made to one of Perot's favorite charities: The Circle Ten Council of the Boy Scouts of America, the Perot Museum of Nature and Science, the University of Texas Southwestern Medical Center, the Salvation Army DFW, the North Texas Food Bank, the Visiting Nurse Association of Texas and Teach for America.

Nystrom's Pond in Thomaston Safe for Swimming Again

Nystrom's Pond in Thomaston is now safe for swimmers after residents were warned to take precaution because unusually high concentrations of e.coli bacteria were found over the weekend.

The Town of Thomaston warned residents to take precautions when swimming at Nystrom's Pond on Saturday after the bacteria was found.

On Tuesday, Torrington Area Health District officials said the water samples are below state action levels and the pond is safe for use by bathers again.

Another test is expected to be done on July 16 as part of routine testing.

Amazon Hiring Event Attracts Hundreds of People

Hundreds of people attended Amazon’s hiring event in North Haven on Tuesday.

It is the first of five events, focused on hiring 1,800 new employees for the new Amazon fulfillment center in North Haven.

Applicants can apply online, then pick a hiring event to take a drug screening and provide necessary proof of citizenship forms.

The starting salary is $15 per hour and full-time employees get benefits on day one.

NBC Connecticut spoke with several applicants excited by the job opportunity.

“Very, very excited,” said John Sturtz, an applicant from Westbrook. “I always wanted to work in a warehouse and I’m good with working with my hands so I think this would be a good fit for me.”

“It’s a new position for me because I am really a CNA but I wanted to try something different and I’m hoping to get hired,” said Marilyn Whichard, an applicant from North Haven.

Although North Haven’s new facility is highly automated, it can still be a physically demanding job.

“A great opportunity but you know, you’re on your feet most of the time, you’re moving very quickly, you’re expected to reach a level of accuracy and safety is very important to Amazon,” said Ann Harrison, the communications director for Workforce Alliance.

If all goes well, an Amazon spokesperson said people will be walking out with contingent job offers.

The next hiring events for Amazon’s North Haven location are from 9 a.m. – 5 p.m.

Man Shot During Police-Involved Shooting in Danbury Identified

Connecticut State Police have identified the man who was shot by a police officer following a reported assault in Danbury last week.

Officers were called to a disturbance at a substance abuse treatment facility on Old Ridgebury Road on Wednesday.

According to police, a man, later identified as 31-year-old Aaron Bouffard, began assaulting people at the treatment facility.

Victims said Bouffard's behaviors escalated as he began wielding two butchers knives near them.

When police arrived, they immediately began trying to find Bouffard.

Officers at the scene said they encountered Bouffard near a recreational soccer field walking towards them with the knives still in his hands.

Police said they attempted to deescalate the incident, however, Bouffard continued to advance towards them and did not listen to any directives to put the knives down.

An officer on scene, later identified as Alex Relyea, fired several rounds at Bouffard and hit him in the thigh, pelvis area and finger, authorities said.

Medical aid was rendered to Bouffard at the scene and he was transported to Danbury Hospital. Bouffard was transferred to Yale-New Haven Hospital, where he remains for further evaluation, officials added.

According to police, Officer Relyea is currently on paid administrative leave. He was also involved in another police-involved shooting last year where one person was killed and another was injured at the Glen Apartments. He has been a police officer in Danbury since 2014.

No arrest has been made for last week's incident, however, authorities said charges for Bouffard are pending.

Police Hope to ID Truck Driver as Dog Burning Investigation Continues

West Haven police are hoping to identify the owner or driver of a vehicle in connection to an incident where a dog was set on fire and killed at a parking lot on Friday.

Officers are emphasizing that the people who were in the vehicle are not suspects. Authorities said they just want to interview them with the hopes that they may have information that can help with the investigation.

Firefighters and police responded to Beach Street near Second Avenue and Third Avenue on Friday around 10 a.m. for the report of a fire in the Sandy Point Beach parking lot.

When they arrived, they put out the fire and found a small dog, possibly a miniature schnauzer, dead at the scene, according to police.

Investigators said it appears the dog was set on fire and abandoned in the parking lot. They said they believe an accelerant was used as well.

Police are asking anyone who may have seen the fire or witnesses suspicious activity in the parking lot between 10 p.m. on July 4 and 10 a.m. on July 5 to call them at (203) 937-3900.

Also, they want anyone who may be missing a small dog in the area to give them a call.
