Day Care Worker Charged With Suffocating Crying 4-Month-Old

A 19-year-old Delaware day care worker is accused of suffocating a 4-month-old girl under her care because the child would not stop crying.

Dejoynay Ferguson, of New Castle, is charged with first degree murder in the death of the infant at the Little People Child Development Center in Bear, Delaware, the Delaware State Police said.

Police responded to the day care around 10:35 a.m. Thursday after a report of an unresponsive child. The girl was rushed to Christiana Hospital, where she was pronounced dead.

Surveillance video at the day care captured Ferguson picking up the girl from the floor by the front of her shirt and then placing her on a changing table, according to an affidavit of probable cause. The video then allegedly shows Ferguson putting on latex gloves and covering the child's mouth and nose for more than three minutes.

The girl was still moving when Ferguson placed her on the changing table, the affidavit said. After the three minutes, she was motionless.

Ferguson told investigators she killed the girl because she was acting "fussy" and would not stop crying, the police document said.

Investigators said Ferguson waited about 20 minutes until she notified the day care center's owner that the infant wasn't moving and someone called 911.

It was not immediately clear if Ferguson had an attorney who could speak on her behalf.

The Office of Childcare Licensing suspended the license of the day care indefinitely as a result of the investigation.

Harris Sorry for Reaction to 'Retarded' Remark About Trump

Sen. Kamala Harris, D-Calif. and a 2020 Democratic presidential contender, apologized Saturday for laughing and saying "well said" in response to a man who described President Donald Trump's actions as "mentally retarded."

"When my staff played the video from my town hall yesterday, it was upsetting," she tweeted. "I didn’t hear the words the man used in that moment, but if I had I would’ve stopped and corrected him. I’m sorry. That word and others like it aren’t acceptable. Ever." 

The senator told NBC News that, "I would never condone that kind of language being spoken by anybody about anybody. It is offensive. I have worked my entire career to do a number of things including to ensure our disability community receives the dignity and the rights that they deserve."

Footage of her response drew rebuke online. The exchange took place at a Friday town hall in New Hampshire, where a man who identified himself as being from Chennai, India, said, "Somehow a racist bigot gets into the White House and then he says if you're not my color you need to go back to your own country."

End Child Marriage in the U.S.? You Might Be Surprised at Who's Opposed

Even as more states take action to end child marriage, concerns about government overreach, along with scant data about the extent of the problem, have driven skepticism to reform across the country, NBC News reports. The divide has sometimes created unlikely alliances between conservative politicians and liberal-leaning groups, including the ACLU and Planned Parenthood.

In California and Louisiana, opponents of change have argued that raising the minimum marriage age is an ineffective solution since other child welfare laws already can prevent young girls from being exploited. And other states, such as Massachusetts, have raised doubts about the extent of the problem, even as experts note that survivors are often reluctant to come forward.

A bill that would have ended child marriage in Idaho — which has no minimum age for couples who want to wed — died in the Statehouse this year. Republican lawmakers, who control the Legislature, opposed it, including state Rep. Bryan Zollinger, who said it "went too far."

"Obviously, I'm against child marriage," the GOP lawmaker told NBC News. "But basically marriage is a contract between people that shouldn't require government permission."

Uber Driver Accused of Kicking Gay Couple Out of Car

An Uber driver has been banned from the app after a woman says she kicked her and her girlfriend out of the car for being gay in an incident that was captured on video. 

Kristin Gauthier said she and her girlfriend were in Oaklyn, New Jersey, trying to get to a concert Friday when a peck on the cheek set their driver off and caused her to force the women from the vehicle. Gauthier recorded part of the encounter on her cellphone.

The women were about four minutes into their ride when Gauthier leaned over toward her girlfriend and said, "Let's have a great night" before giving her a kiss on the cheek, she said.

Upon seeing that, the driver immediately told the couple they needed to get out of the car and pulled over to the side of the road, Gauthier said.

"She said, 'You're together. You're not allowed in my car. I'm not gonna drive you,'" Gauthier recalled. The driver told the women she did not condone their relationship because of her Christian beliefs, Gauthier added.

"I was confused because that has not happened to me before," Gauthier said.

Gauthier's girlfriend - who Gauthier said has experienced discrimination before because she has been openly gay for longer - quickly exited the car after telling the driver that as a Catholic, she too was Christian, Gauthier said. But Gauthier began recording.

"Are you kicking me out because I'm gay?" Gauthier says in the video. "Yes, I am, yes," the driver replies.

Things escalate as Gauthier continues recording, with the driver reaching back and apparently trying to swat the cellphone away. Both women begin shouting as the driver repeatedly tells Gauthier to "get out" and Gauthier uses an expletive to ask what is wrong with the driver.

The driver tells Gauthier that she is operating her personal vehicle and continues to tell her to get out, while Gauthier counters that she is paying for a service. "I can reject any ride I want," the driver says.

The video also shows Gauthier daring the driver to call the police, which the driver says she will do. Police were not called and Gauthier's girlfriend eventually convinced her to get out of the car, Gauthier said.

Though the driver said in the video that she has a right to reject any rider she wants, Uber's guidelines explicitly forbid discrimination. In a statement, Uber spokesman Grant Klinzman said that "Uber does not tolerate discrimination" and that the company has removed the driver's access to its app.

For her part, Gauthier said she was happy with Uber's response and with the mostly positive reaction from people, including rideshare drivers who have reached out to her to express support.

She regrets some of the language she used in the video but hopes the incident will shine a light on the issue of discrimination.

"People need to know that it does happen, and it's not right," Gauthier said.

Whale, Sailboat Almost Collide Near Golden Gate Bridge

Whale watchers soaking in the sights near the Golden Gate Bridge in San Francisco Saturday afternoon witnessed a whale and sailboat nearly collide.

Video of the close call showed the whale surface for air right in front of a sailboat, forcing the crew on the boat to make a hard turn and steer clear of the animal's path.

The crew on a nearby San Francisco Whale Tours boat said the whale was OK.

The encounter happened around 5 p.m. about 500 yards west of the bridge.

Earlier this month, whale watchers said a whale was struck and killed by a ship near Alcatraz.

Air Force Probes Layovers After Crew Stayed at Trump's Hotel

The Air Force said Sunday that it doesn't appear any regulations were broken when a military crew flying from Alaska to Kuwait stopped off in Scotland and stayed overnight at a resort owned by President Donald Trump, NBC News reported.

But it has decided to investigate all such sleepovers anyway, it said, because of a possible perception that it's "not being good stewards of taxpayer funds."

The stop in March at Trump Turnberry, about 40 miles southwest of Glasgow, has been the subject of an ethics investigation by the House Oversight and Government Reform Committee for weeks, but it wasn't publicly disclosed until Politico reported the trip on Friday.

In a letter in June to Patrick Shanahan, who was acting defense secretary at the time, committee leaders said they were investigating whether Trump may have benefited from "receipt of emoluments in violation of the U.S. Constitution."

Community Remembers Teen Killed in Quadruple Shooting in Hartford

People are remembering a teenager who died after a quadruple shooting in Hartford.

The mother of Usher Hanns tells us her son had just started his senior year at Weaver High School.

“Usher was a good son. He made me smile here. He was smiling. He always made me smile. He’s a joyful kid,” said Georgiann James, the mother of Hanns.

Community activists believe people should be outraged that the shooting took the life of a teenager and they should be demanding change.

Police say the 17-year-old died on Wednesday after being shot on Edgewood Street one week ago.

“What we want to see is some changes. And how to do that we got start within ourselves,” said Rev. Henry Brown of Mothers United Against Violence.

On Sunday, community members gathered for a vigil where the gunfire erupted.

Among the crowd were the boy’s friends and family, including a brother.

“We must help them so that this doesn’t continue to happen,” said Henrietta Beckman of Mothers United Against Violence.

For years, Hanns had been part of Hartford’s Proud Drill Drum & Dance Corp, which has a goal of keeping kids busy and off the street.

The group performed as part of Sunday’s vigil.

Many can’t believe Hanns is gone after the shooting, which also wounded three other people.

“Usher didn’t deserve this. Usher was a very good kid. And whoever did this needs to come forward,” said Terry Starks of Hartford’s Proud.

Community members ask anyone with information about the shooting to contact police.

Hartford’s Proud will be putting on a “Stop the Violence Event” at Dillon Stadium coming up on September 21st.

VIDEO: Tesla Driver Asleep Behind Wheel on Mass. Turnpike

A driver on the Massachusetts Turnpike saw a motorist in the lane next to him asleep behind the wheel Sunday.

Dakota Randall says he was driving on Interstate 90 when he noticed a Tesla with its driver and passenger both asleep around 3 p.m. near Exit 17 in Newton.

"I kind of looked over and saw what I thought was somebody asleep at the wheel and I was like that can’t be right, so I did a double take, looked over and sure enough this guy was just, head between his legs completely asleep,” Randall told NBC10 Boston. "It seemed like he had his cruise control on around like 55-60 miles per hour."

Randall sat stunned before pulling out his phone to record. He tried honking to wake the driver and passenger up but says "it didn't work at all." 

Randall estimates he drove next to the Tesla for about 45 seconds to a minute before speeding up and leaving the sleeping driver behind.

He later shared the video on Twitter, writing, "Some guy literally asleep at the wheel on the Mass Pike (great place for it). Teslas are sick, I guess?"

It's not clear how long the Tesla driver and his passenger were asleep for or when they woke up.

Randall says the uncertainty of how the situation unfolded is even scarier than seeing an inattentive driver. He now has a new perspective on how he'll drive around self-driving cars.

"I'm never going to look at one the same," he said. "I'm always going to look to see if somebody's asleep."

The Tesla Autopilot feature is designed to actively guide cars from on-ramp to off-ramp, including suggesting and making lane changes, navigating highway interchanges, and taking exits. However, Tesla says on its website that the feature is intended for use with a fully attentive driver, who has their hands on the wheel and is prepared to take over at any time.

Randall did not contact police after taking the video. State police tell NBC10 Boston they are aware of the incident from media reports but they were not contacted by anyone nor were they sent the video.

Route 80 in Killingworth Reopens After Crash, Downed Tree

Route 80 in Killingworth has reopened after a crash and downed tree closed it briefly on Monday morning.

State police said a vehicle crashed into a large tree and knocked the tree across Route 80 around 4 a.m.

The road was closed near the Killingworth Reservoir, authorities said. It has since fully reopened.

It is unclear if anyone was injured in the crash.

4 in Custody Following 2 Stolen Vehicle Pursuits in Old Saybrook

Four people are in custody after two stolen vehicle pursuits in Old Saybrook late Sunday night and early Monday morning.

An Old Saybrook police officer was engaged in pursuit by a stolen vehicle on Sunday night. When the vehicle came to a stop, two people fled from the vehicle and one was immediately taken into custody, police said.

The other person continued on foot towards the wooded area behind Goodwin Elementary School, according to officers. The area of the school was thoroughly searched by police.

While searching, authorities said a Dodge Hellcat was stolen from Old Saybrook early Monday morning and engaged police in a pursuit.

Officers worked with the vehicle manufacturer and Connecticut State Police to find the vehicle.

According to police, the vehicle was remotely slowed down and disabled on Interstate 95 in Stratford. Three people fled from the vehicle on foot and Connecticut State Police apprehended all of them. 

All four people who were arrested are at the Old Saybrook Police Department.

Police do not believe there are any more suspects at large. 

There are no security concerns at Goodwin Elementary School. 

The incidents remain under investigation. Officers have not said if they are related.

NJ Woman Charged With Murdering Her Mother: Prosecutors

A 23-year-old woman was charged with murder in the stabbing death of her mother in their New Jersey home, prosecutors said. 

Marisa Rivera, of Pine Cove, was charged with first-degree murder and weapons offenses, the Bergen County Prosecutor's Office said. 

Prosecutors say she killed her 56-year-old mother, Denise DeNapoli, in their apartment at about 3:30 a.m. Friday. 

Police discovered DeNapoli's body during a wellness check after she didn't show up for work. 

The daughter was arrested late Friday at a hotel on Route 73, prosecutors said. 

The motive was still being investigated. 

It wasn't clear whether Rivera had an attorney.

16-Year-Old Boy Stabbed on Manhattan Subway Platform

A 16-year-old boy was stabbed twice on a Manhattan subway platform by a group of about eight men, authorities say.

A call about the stabbing on the northbound C train platform at 96th Street and Columbus Circle came in shortly before 2 a.m. Monday. It wasn't clear if there was an argument and robbery or even words exchanged prior to the stabbing, but the boy was cut once in the torso and once under the arm. 

He was taken to a hospital in stable condition and is expected to survive. 

Police say the attackers are believed to be in their late teens or early 20s. Anyone with information is asked to call Crime Stoppers at 1-800-577-TIPS.

Man Arrested for DUI in Connection to Fatal Crash in New Haven

New Haven police have arrested a man for driving under the influence in connection to a fatal crash involving a motorcycle on Saturday night.

Officers were called to Winthrop Avenue at Sylvan Avenue around 5:30 p.m. after getting a report of a crash with major injuries.

Police said a 4-door sedan and a motorcycle were involved in the crash.

The 28-year-old motorcyclist, who was from New Haven, did not survive his injuries, authorities added. His identity has not been released.

According to police, the driver of the 4-door sedan was identified as 42-year-old Jerry Boucicault, of New Haven. He was arrested and charged with operating a motor vehicle while under the influence.

Boucicault was held on a $100,000 bond and is due in court on Monday.

The crash remains under investigation.

4-Year-Old Girl Reported Missing From Hartford

Connecticut State Police have issued a Silver Alert for a 4-year-old girl who is missing from Hartford.

Police said Samara Waden has been missing since Sunday and was last seen wearing a white shirt with blue sleeves and pink leggings.

Waden has black hair and brown eyes and is 3'0" and 43 pounds.

Authorities believe she may be with Anthony Powell, who officers said is her mother's boyfriend.

Big Warm Up Arrives by Middle of Work Week

The beginning of the work week will be cool before a big warm up moves in during the middle of the week.

Monday and Tuesday will begin comfortably cool with partly sunny skies and highs in the low 70s.

A big warm up will arrive by Wednesday and brings highs in the mid and upper 80s. Parts of the state could approach 90 degrees.

A few showers and storms are possible starting Wednesday late in the day through the end of the week.

Woman Arrested for DUI in Wilton Twice in Same Day

Wilton police said a woman was arrested twice in the same day after allegedly driving under the influence on Saturday afternoon and then again on Saturday night.

Officers received a call from a citizen around 2:30 p.m. who said a woman, later identified as 64-year-old Ellen Needleman-O'Neill, of Wilton, was driving and hit a parked vehicle in the parking lot of 5 River Road.

The complainant told police that he believed Needleman-O'Neill was intoxicated, authorities said.

Police detected an odor of alcohol coming from Needleman-O'Neil and conducted field sobriety tests, which officers said she failed.

She was arrested for operating a motor vehicle while under the influence of alcohol and/or drugs.

When she was taken to headquarters, police said her blood alcohol content was a .2261. Officers also said they found Tylenol/codeine pills in her purse.

Needleman-O'Neill was later charged with operating a motor vehicle while under the influence of alcohol and/or drugs and possession of a controlled substance, police added.

She was released on a written promise to appear and was given a court date of September 17.

Hours later, a complainant identified Needleman-O'Neill as the subject of an earlier DUI arrest as she walked into a liquor store to buy alcohol, police said.

After she left the store, she drove away in her vehicle, which was found a short time later on Old Farms Road as Needleman-O'Neill was heading back home around 8:20 p.m., according to police.

Her vehicle was stopped and she was found to still be under the influence of alcohol and/or drugs, officers added.

Police said they later learned that Needleman-O'Neill was not in possession of a valid driver's license, her vehicle was unregistered and her right to drive had been revoked earlier in the day due to her previous DUI arrest.

At headquarters, Needleman-O'Neill agreed to take a breath test and police said her results were .0928.

For the second incident, she was charged with DUI, operating a motor vehicle while right to drive is revoked, unregistered motor vehicle and driving without a license, officers said.

She was released after posting her $230 bond and was given a second court date of September 17.

ATV, Dirt Bike Riders Swarm New Haven Streets: Police

Police arrested nine people on Sunday after responding to what they called mayhem of "roving droves" of ATVs and dirt bikes through city streets.

As many as 200 street racers caused traffic problems and endangered pedestrians in New Haven, according to police.

Some of the bikes and atvs went up on sidewalks, while other riders swarmed police vehicles, kicking and spitting on them, police said.

"We successfully made arrests and seizures of those creating havoc in the city," Patrol Commander Lt. Mark O'Neill said.

Those arrested were:

  • Adrian Perez, 25, New Jersey
  • Rashon Doran, 33, Stratford
  • Byron O’Leary, 26, Meriden
  • Hugo Valentin, 23, New Haven
  • Juan Reveron, 33, New Haven
  • Jomar Cancel, 23, New Haven
  • Dereyk Grant, 39, New Haven
  • Justin Gallogly, 24, New Haven
  • Charles Brewer, 23, New Haven

The charges range from motor vehicle violations, to reckless endangerment, and drug offenses.

Crumbling Basement Assistance Program Releases Data On Millions In State Aid at Work

The state program assisting people with defective concrete basements has released new data on its work.

NBC Connecticut Investigates broke the story about crumbling foundations four years ago.

The Connecticut Foundation Solution Indemnity Company, or CFSIC, said since it opened for business this year, more than 1,100 claims for assistance have been filed.

CFSIC’s newly released annual report showed the 10 towns with the highest number of properties affected: Vernon, Tolland, South Windsor, Willington, Manchester, Stafford, Ellington, Coventry, Ashford, and Somers.

The crumbling basements are impacted by disintegrating concrete containing pyrrhotite, an iron sulfide that has reacted naturally with oxygen and water over the decades. Most homes affected begin showing signs of deterioration between 10 and 20 years after construction.

CFSIC added its assistance is helping bring dozens of homes back on the tax rolls and has pumped money into the local economy by creating construction jobs.

The state has agreed to fund CFSIC with $100 million in bonding money, along with other revenue from a $12 surcharge on Connecticut homeowner insurance policies.

Suspicious Package at Charlotte Hungerford Hospital Not Dangerous: Bomb Squad

The Connecticut State Police Bomb squad responded to Charlotte Hungerford Hospital in Torrington after a suspicious package was delivered to the mailroom Monday.

Torrington police said the mailroom received a package with no return address, a misspelled name with no obvious postal markings, and the recipient was not expecting a package.

The bomb squad responded and determined the package was not dangerous and there was no threat.

No other details were immediately available.

New Britain Renovating Aging Firehouse

Renovations are underway at one of the City of New Britain’s aging firehouses. From asbestos, to broken windows to no female bathrooms, there’s a long list of improvements needed.

“We’re not asking for the luxuries,” said New Britain Fire Chief Raul Ortiz. “We’re very simple people. We want a roof that’s not going to leak. We want accommodations when we come back from a fire to be able to wash up, to stay dry, warm or cool as needed, no different than any other business or working condition.”

Construction at Station 4 is a first step to bringing the city’s fire stations up to date.

“The average firehouse is about 59 years old with minor renovations done to these houses,” Ortiz said. “So we’re going to address it slowly, but we want to do it the right way.”

He said the initial assessment to fix all fire stations came back at around $15 to $18 million. The city has allocated about $3 million for firehouse improvements. Ortiz says they’re doing the work on a priority basis.

There’s a plan in place to cover firehouses while they’re under renovation, to make sure construction doesn’t impact response times.

“I just ask that if there’s ever a situation that you need to call 911, don’t delay, don’t wait please call so that we can respond in a timely manner,” Ortiz said.
